What is Copyright?
Copyright is a legal concept that grants exclusive rights to creators and owners of original works, giving them control over the use and distribution of their creations. It is a form of intellectual property protection that safeguards creative and artistic works from unauthorized copying, distribution, and exploitation.
In Pakistan, copyright is governed by the Copyright Ordinance, 1962 (as amended by the Copyright (Amendment) Ordinance, 2000), administered by the Intellectual Property Organization of Pakistan (IPO-Pakistan). Under this law, the owner of a copyrighted work has the exclusive right to reproduce, distribute, publicly display, perform, and make derivative works based on the original creation. These rights allow creators to control how their works are used, and they can license or sell these rights to others for a fee or royalty.
Note: A Copyright (Amendment) Bill, 2026 has been introduced in Parliament to modernize the 1962 Ordinance. As of now it has not been passed into law and is under committee review, so the current legal framework remains the 1962 Ordinance as amended in 2000.
Copyright protection covers a wide range of creative works, including:
- Literary works – books, magazines, journals, dramas, novels, computer programs/software, lectures, compilations of data, etc.
- Artistic works – paintings, photographs, maps, drawings, charts, calligraphy, sculptures, label designs, logos, architectural works, monograms, and other works.
- Cinematographic works – audio-visual works, movies, documentaries, etc.
- Musical/record works – musical works, sound recordings, etc.

- Strengthens legal rights by creating a legal presumption of ownership and validity.
- Enables owners to seek legal remedies such as injunctions, damages, and court orders in case of infringement.
- Creates a public record of ownership, serving as notice to others and reducing the likelihood of unintentional infringement.
- Facilitates licensing and commercial exploitation of works, allowing creators to monetize their work through authorized use and distribution.
What is a Trademark?
A trademark is a distinctive sign, symbol, logo, design, word, phrase, or combination thereof used to identify and distinguish the goods or services of one business from those of others. It is a form of intellectual property protection that helps consumers recognize and associate particular products or services with a specific brand or source.
Trademarks play a crucial role in business by establishing brand identity, reputation, and goodwill. They help consumers make informed choices and build trust and loyalty toward a brand, while preventing others from using similar signs that could cause confusion in the marketplace.
In Pakistan, trademarks are governed by the Trade Marks Ordinance, 2001 (as amended by the Trade Mark (Amendment) Act, 2023) and the Trade Mark Rules, 2004, administered by IPO-Pakistan. Pakistan acceded to the Madrid Protocol for international trademark registration in 2021, and the 2023 amendment formally incorporated provisions for international registration under the Protocol, expanded IPO-Pakistan’s administrative powers, and established the Intellectual Property Tribunal to hear trademark matters (replacing the earlier District Court jurisdiction).
Trademark protection covers a wide range of marks, including:
- Word marks: brand names, slogans, taglines, or other distinctive words used to identify products or services.
- Logos and designs: unique visual symbols or graphical elements representing a brand or product.
- Product packaging (trade dress): distinctive packaging, including shape, color, or overall appearance.
- Sound marks: unique, distinctive sounds associated with a brand or product.
- Motion marks: animated or moving images used to distinguish goods or services.
- Slogans and taglines: catchphrases associated with a brand or its offerings.
- Service marks: marks used to identify and distinguish services.
- Collective marks: marks indicating membership or affiliation with a group or organization.
- Certification marks: marks certifying quality, origin, or other characteristics of goods or services.
- Non-traditional marks: colors, holograms, scents, and other marks outside the traditional categories.
How to Register a Trademark in Pakistan
- Determine the classification – Pakistan follows the Nice Classification system, with 45 classes in total (classes 1–34 for goods and 35–45 for services).
- Conduct a trademark search through IPO-Pakistan records to check for conflicts with existing marks.
- File the trademark application with IPO-Pakistan (using the prescribed TM forms).
- Examination and response to objections, if any are raised by the Registrar.
- Publication of the accepted mark in the IPO’s Trademarks Journal, opening a period for third-party opposition.
- Issuance of the registration certificate once the opposition period passes without a successful challenge.
A registered trademark is valid for 10 years from the date of registration and can be renewed for further 10-year terms.
Benefits of Trademark Registration in Pakistan
- Grants exclusive rights to use the mark for the specified goods or services, preventing others from using confusingly similar marks.
- Provides a legal presumption of ownership and validity, making it easier to enforce rights and take legal action against infringers.
- Acts as a deterrent against imitation, given the legal consequences attached to infringement.
- Helps build brand recognition and a strong market presence.
- Provides a competitive advantage by protecting against use of similar marks by others.
- Allows licensing of the mark to others, creating additional revenue streams.
- Functions as an intangible business asset that can factor into valuations for mergers, acquisitions, or financing.
- Strengthens your legal position in infringement cases, supporting claims for damages, injunctions, and other remedies.
- Provides a basis for pursuing protection abroad, including through the Madrid Protocol, of which Pakistan is now a member.
- Builds consumer confidence and trust by signaling an established, reputable brand.
